Hatch Act Case Update

Please see the attached notification from the Postal Service. As you are aware, we had initiated a national dispute when the Postal Service informed the APWU they were going to unilaterally change the ELM to disallow union officials from taking LWOP for partisan political activities. They then unilaterally changed PS-Form 3971 to require union officials certify they would not be conducting partisan political activity while on Leave Without Pay.

The arbitrator ruled in our favor and ordered the Postal Service to rescind the proposed changes to the ELM and change PS-Form 3971 back to the older version. The Postal Service filed suit in federal court to have the award vacated. Earlier this year, the case was dismissed. The Postal Service is now complying with the original award. 

The ELM changes were actually never printed in the ELM. The notice makes it official that they will not be. The notice also declares all versions of PS-Form 3971 obsolete and makes the new July 2021 version the appropriate form to use. Offices are instructed to destroy all unused obsolete versions of the PS-Form 3971, order new pads, and use the new form that no longer includes the certification line. 

This was a great win for the APWU.
